URGENT Action Needed to Stop Solar Construction

Invenergy is intending to begin construction on its Fountain Point industrial solar project next week, and Citizens Against Fountain Point (CAFP) needs your help!
⚠️ The time to act is now. The next few days are critical.
How you can help
If Invenergy truly plans to begin construction next week, then we have very little time to act.
If you want to protect our community, we are respectfully asking every concerned citizen to immediately send an email to the OPSB demanding answers to the following questions:
❓ How is Invenergy being allowed to commence construction without satisfying Stipulations 7, 17, and 44?
❓ Stipulation 44 is particularly important, so how can it be ignored?
(Stipulation 44 requires Invenergy to reach an agreement with local fire and EMS departments regarding necessary emergency equipment, safety training and preparedness. But this stipulation currently CANNOT be satisfied because it requires a vote from Bokescreek Township, and the township cannot hold a quorum since two trustees are lease holders in Fountain Point! This issue was so significant that during Supreme Court oral arguments, both Justice Kennedy and Justice DeWine specifically pointed out to the OPSB that the project cannot move forward unless Stipulation 44 is satisfied — and right now, it cannot be satisfied!)

Background
On April 10th, Invenergy submitted three documents to the Ohio Power Siting Board (OPSB) regarding the Fountain Point solar project. These documents outline their intent to construct 12 inverter pads, each consisting of 12 pilings driven into the ground with concrete pads poured over them. According to Invenergy, construction is expected to begin in May, as early as next week.
Invenergy claims that they have satisfied OPSB's stipulations. However, Invenergy has NOT satisfied Stipulations 7, 17, and 44 (which can be viewed and downloaded below). These stipulations must clearly be satisfied prior to any construction.
This means Invenergy is attempting to move forward with construction, and, sadly, the OPSB is not enforcing its own stipulations, which means the responsibility to raise the alarm falls on us, the concerned citizens.
What Citizens Against Fountain Point (CAFP) has done so far
✅ Our steering committee has contacted our attorneys, who are currently drafting a formal letter to the OPSB.
✅ We also met with the County Commissioners to alert them to Invenergy’s intentions and encouraged them to send their own letters to the OPSB.
✅ We have now been alerted that at least one local business received a letter from Invenergy stating they intend to begin building the inverter pads NEXT WEEK. 😡
✅ We expect additional letters may soon be sent to residents adjacent to the project. If you receive one of these letters, please notify CAFP or Top of Ohio Patriots immediately!
How can Invenergy start construction if the case is still in the Ohio Supreme Court?
Many of you have asked this question. Yes, our case is still before the Ohio Supreme Court, and we are still awaiting a final ruling. However, the Supreme Court case alone does not automatically prevent Invenergy from beginning construction. The way to stop construction is to draw the OPSB's attention to the fact that Stipulations 7, 17, and 44 are being ignored.
Invenergy has likely delayed construction until now because if the Supreme Court rules in our favor later, Invenergy could be forced to tear everything down. But we simply can't put all our eggs in that basket!
